Please read these Terms of Use ("Terms") carefully before using Whisper Dictator software and website. By downloading, installing, or using the software, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Whisper Dictator, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the software.

2. Description of Service

Whisper Dictator is a desktop application that provides offline speech-to-text transcription using OpenAI's Whisper AI model. The software runs entirely on your local computer, ensuring complete privacy of your audio data.

3. License Grant

3.1 Free Tier

The free version of Whisper Dictator grants you a limited, non-exclusive, non-transferable license to use the software for personal or commercial purposes, subject to the following limitations:

• 7 transcriptions per day
• All features and AI models are available
• Single device use

3.2 Paid Licenses

Paid licenses (Annual or Lifetime) grant you:

• Unlimited transcriptions
• Use on multiple devices (2 for Annual, 3 for Lifetime)
• Priority support
• All future updates during the license period

3.3 License Restrictions

You may NOT:

• Share, sell, or transfer your license key to others
• Reverse engineer, decompile, or disassemble the software
• Remove or modify any proprietary notices
• Use the software to violate any laws or regulations
• Circumvent the license validation system

4. Intellectual Property

Whisper Dictator, including its code, design, logos, and documentation, is the property of Sincron IA Digital and is protected by copyright and intellectual property laws.

The Whisper AI model is developed by OpenAI and is used under the MIT license. We do not claim ownership of the Whisper model.

5. Payment and Refunds

5.1 Payment

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

5.2 Pricing

• Free: $0 forever (7 transcriptions/day)
• Annual: $39.99/year (renews automatically unless cancelled)
• Lifetime: $99 one-time payment

5.3 Refund Policy

We offer a 14-day money-back guarantee for all paid licenses. If you are not satisfied with the software, contact us at support@whisperdictator.com within 14 days of purchase for a full refund.

Refunds are not available after 14 days or if the license has been used extensively.

5.4 Annual License Renewal

Annual licenses renew automatically. You can cancel at any time before the renewal date. No refunds are provided for partial periods after renewal.

6. Device Activation

Your license is tied to specific devices using a machine fingerprint. You may deactivate a device to free up a license slot:

• Annual: Up to 2 active devices
• Lifetime: Up to 3 active devices

If you change your computer hardware significantly, your fingerprint may change, requiring reactivation.

7. Updates and Support

7.1 Software Updates

We may release updates to improve functionality, fix bugs, or address security issues. Updates are provided free of charge for:

• Annual: During the subscription period
• Lifetime: Forever

7.2 Support

Support is provided via email at support@whisperdictator.com. We aim to respond within 48 hours for paid users and 5 business days for free users.

8. Disclaimer of Warranties

We do not guarantee that:

• The software will be error-free or uninterrupted
• Transcription accuracy will meet specific requirements
• The software will be compatible with all systems

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WHISPER DICTATOR, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE.

Our total liability shall not exceed the amount you paid for the software license.

10. Indemnification

You agree to indemnify and hold harmless Whisper Dictator and its developers from any claims, damages, or expenses arising from your use of the software or violation of these Terms.

11. Termination

We may terminate or suspend your license if you violate these Terms. Upon termination:

• Your right to use the software ends immediately
• No refund will be provided for violations
• You must uninstall and delete all copies of the software

12. Third-Party Components

Whisper Dictator uses the following third-party components:

• Whisper AI (OpenAI): Speech recognition model, MIT license
• whisper.cpp (ggerganov): C++ port of Whisper, MIT license
• Electron: Desktop framework, MIT license
• FFmpeg: Audio processing, LGPL license

These components are subject to their respective licenses.

13. Governing Law

These Terms are governed by the laws of Brazil. Any disputes shall be resolved in the courts of Sao Paulo, Brazil.

14. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes by email or through the application. Continued use after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Whisper Dictator regarding the use of the software.
